The government has submitted a formal request to India, under the bilateral extradition treaty, to facilitate the return of ousted Prime Minister Sheikh Hasina to Bangladesh. Law, Justice and Parliamentary Affairs Minister Md. Asaduzzaman stated that the process will be guided strictly by law and state regulations, rather than by emotion.

He made these remarks on Sunday morning (November 8) while responding to journalists following the inauguration of a workshop titled "Integrity in Judicial Proceedings," organized by Transparency International Bangladesh (TIB) at a hotel in the capital.

Legal Process Underway for Sheikh Hasina’s Return

In response to a question from journalists regarding whether there would be a legal battle with the Indian government to bring Sheikh Hasina back, the Law Minister stated that the government is taking all necessary steps through the proper legal channels.

He emphasized that any future actions taken in this regard will also be carried out in full compliance with the law. The government’s stance is not driven by emotion; rather, the primary objective is the proper application of existing laws.

According to the Law Minister, a formal request for the handover of Sheikh Hasina has already been submitted to the Indian government, in accordance with the bilateral extradition treaty.

To Be Produced Before a Court Upon Handover

Noting that India’s judicial processes are an internal matter for that country, the Law Minister stated that if India hands Sheikh Hasina over to Bangladesh, subsequent actions will be taken in accordance with the country’s prevailing laws.

He added that once she is returned to the country, the necessary procedures will be followed to produce her before a court of law.

Regarding India’s Characterization of Sheikh Hasina

Addressing a question from journalists about India viewing Sheikh Hasina as a "state guest" rather than a detainee, the Law Minister clarified the government’s position.

He asserted that how India chooses to perceive her does not alter Bangladesh’s legal position. Sheikh Hasina has been tried in an open court in Bangladesh, and a national tribunal has declared her a convicted criminal.

As per the Law Minister’s statement, within the framework of Bangladesh’s legal system, Sheikh Hasina is classified as a convicted individual. The government will follow the same legal position regarding his return as well.
